Phil Tatlow recently obtained the policy limits for his client on an ERISA life and disability case that he handled against Great West Insurance Company and Anheuser-Busch Companies, Inc. This case involved D.H. who was a beer brewer that had to retire in 1996 due to various health issues. He applied for and was granted Social Security benefits. In 2006 D.H. was told by former co-employees that he should have applied for a buy-out of his life insurance policy when he retired. He attempted to apply with Great West and Anheuser-Busch and was told that the time under the contract and statutes to apply was only three years and it was too late for him to make a claim. Phil Tatlow handled the case and filed a complaint against Great West Insurance Company with the Director of Insurance alleging that Great West breached their fiduciary duty to D.H. and that they along with Anheuser-Busch fraudulently concealed the existence of valuable benefits and the time to sue them never ran. At the time that Great West and Anheuser-Busch finally agreed to pay the claim it was over 10 years past the time to sue them under a normal reading and application of the statute. We could not find any ERISA cases like this and believe this is an excellent result for our client.
